Are they not allowing us to power up the BND legend for the 20 tokens or is my end glitching?

I took Dawkins as my player and was able to upgrade him.  Im not sure what is going on with yours.

The 96 ovr version is not the card that you upgrade. You have to get the lower ovr power-up card, and the 96 can be used to power it up. The power-up cards are the pink Legends cards.
