It's how recent it was. And players have rights to their appearance and name, meaning they or someone entrusted with those rights has to give EA those rights in order for the player to be in the game. My educated guess is that the other dead players who are eligible to be the game had family members who allowed EA to put them into the game.

Ok then,you did say its insensitive to ask for rights,but if some family members will allow it,then there is a chance we could add a few more players to the ultimate team database,right?

That is correct, although EA usually settles the rights for whichever players can be in the game before the games release.

Boring Recylce Bowl is more like it. No Terrell Owen's is a let down. I guess EA didn't put that many players under contract this year sadly.  From here on out its just going to be whatever players in the game currently with +2 ovr each promo. Lazy.
