Contrary to some posts I have seen here, and yours as well, EA has the right to use most all current and former players image and likeness. As long as the player is in the NFLPA, they have the rights.
They have a compensation (financial) agreement with with NFLPA for the rights to every single current and most former players (including legends).NFL players are not compensated directly from EA.
So, any player mentioned here that EA "doesn't or may not have the rights to", retired or not, is not accurate and EA can include in the game, so long as they're in the NFLPA.
They have all players' NIL rights through the NFLPA deal and individual players are not paid directly.
For example: EA doesn't call Randy Moss and ask him how much money he wants for EA to use his NIL in Madden. They already have those rights through the deal with the NFLPA, which represents every single current and former player in the financial discussions and deal with the EA Sports.
Basically, the NFLPA is the agent for all of the current and former NFL players for their NIL for Madden as long as they're a member of the NFLPA.
And just for knowledge, the teams logos and such, goes through the deal with the NFL, not the NFLPA. It's a seperate deal. The coaches also have a seperate deal with EA Sports through the NFLCA (NFL Coaches Association). This is why Bill Belichick isn't in Madden. He is not member of the NFLCA.
I am mentioning this because EA can make MOST any player a card that they want. Retired or not. Legend or not. Its already paid for in the contract deal with the NFLPA.

I recently read something about the college players. What I read makes it seem like the college players get a small payment for allowing their likeness in the game. I imagine this is because they are not unionized? I read that Arch Manning was not participating because he wanted to concentrate on football, so I would assume he is not in the college game?

Yes. Ncaa players are not unionized (it will likely happen eventually, couple players from Northwestern were trying) but they're not right now.
Currently, college players can "opt-in" to be included in the game for $600 in compensation.

Nah, unless something happened in the 2020 CBA, the NFLPA loses the rights to a players likeness after retirement paperwork is filed, as they are no longer involved in league operations. EA needs to make individual deals to retired players, such as Randy Moss. The NBA has a retirement association that includes likeness, the NFL does not. The entire premise of “Tribute cards” is to pump 1 final OP card, as they are losing their rights and have no idea when they will be back in the game. Mutguru mentioned this back when he worked at EA over 6 years ago. It’s the main reason EA lags behind 2k for past player additions, the NBA makes it easier

Retired players NIL for the NFL is managed through the Football Greats Alliance FGA as a whole. Players absolutely can opt-in and opt-out to various licensing ventures.

Actaully, it seems you're correct. I stand corrected on the retired players.
After further research, current NFL players can also opt-out of NIL deals that have been agreed upon by EA and the NFLPA, while still being a member of the NFLPA. Wondering if retired players can opt-in through the NFLPA after retirement? There is also the PFRA (Pro Football Retired Association) , but it does not show having EA as a licensing partner.
My mistake on the retired players' portion.

I knew someone was handling it as a whole and no way EA was dealing with each individual retired player. Never claimed to be an expert on this specific matter. .

They have to still pay retired players Dez Bryant and Terrell Owens both said they are not in the game because they were offered 10k for their likeness and that it was way too low. Same thing Cam Newton mentioned as well. Ea has to have a deal with retired players individually if there are not parr of some retirement associatio.

The rollout was botched by happening immediately upon a Supreme Court ruling rather than being decided with all the ADs at the table the rules and punishments for breaking said rules were not agreed upon to increase and perpetuate parity such as an NIL team cap and anti poaching rules in the sport so now poaching is just going to happen in the open at the expense of smaller schools who luck into signing a talented player who falls through the cracks of the big boys recruiting ventures. A player plays too well at a smaller school and they have to offer him crazy amounts of money to stay and they can’t compete with the same 5 schools you mentioned and the rich schools who did the same stuff worse as there is no cap and tampering goes unpunished. The sport has lost what made it better than the NFL.

I thought that if a player plays for a specified amount of time (3 years?), they become eligible for a pension? Would this pension cause continued ties with the league?

I do agree it'll ruin the final product, but I'd blame the transfer portal rule change more than anything. The kids were going to get paid to change schools anyway.
